These terms govern your use of our website and online enquiry services. A vehicle purchase or sale is also governed by the final written agreement and applicable Australian and Victorian law.

Important distinction

Browsing a listing or sending an enquiry does not itself create a vehicle sale. Any sale is subject to vehicle availability, required checks, agreement on price and terms, and completion of the applicable written contract and statutory documents.

Acceptance of these terms

By accessing or using this website, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, please stop using the website.

“Roos”, “we”, “our” and “us” refer to Roos Car Buy & Sell. “You” refers to a website visitor, customer, prospective purchaser, vehicle owner or person submitting an enquiry.

Website purpose and permitted use

This website provides general information about Roos Car Buy & Sell, vehicles that may be available, and ways to enquire about buying or selling a vehicle.

You must not:

  • use the website unlawfully, fraudulently or to mislead another person;
  • interfere with website security, availability or functionality;
  • upload malware, harmful material or content you do not have authority to provide;
  • attempt unauthorised access to our website, portal, records or systems; or
  • copy, scrape or commercially reuse substantial website content without permission.

Vehicle listings and information

We aim to present vehicle information accurately. Listings may include photographs, price, model, variant, year, kilometres, transmission, fuel type, features and other details.

Vehicle information can occasionally contain an error or omission. Colours and appearance may vary because of lighting, photography and screen settings. Accessories shown may not be included unless stated in the final sale documentation.

Before committing to a vehicle, confirm the important specifications, inclusions, condition, price and availability directly with our team and review the contract and vehicle data sheet.

Prices, availability and corrections

Vehicles remain subject to prior sale or withdrawal. An online listing is not a promise that the vehicle will remain available until a contract is signed or any agreed holding arrangements are completed.

Advertised pricing will be handled in accordance with applicable Australian and Victorian requirements. The final contract will set out the agreed price, inclusions and applicable charges.

If a listing contains a genuine clerical, technical or pricing error, we may correct the listing. Nothing in this clause permits misleading conduct or limits rights available under applicable law.

Enquiries, inspections and test drives

Sending an enquiry does not reserve a vehicle. Appointments and test drives are subject to confirmation, vehicle availability and reasonable identification, licence, age, safety and insurance requirements.

You must follow staff directions and operate any vehicle lawfully and carefully. We may refuse or stop a test drive where reasonably necessary for safety, security or legal compliance.

Vehicle purchases and contracts

A vehicle sale becomes binding according to the final written contract, not merely because a website enquiry was submitted. The contract may cover payment, deposit, trade-in, delivery, transfer, included items, conditions and any applicable warranty.

Customers should read all documents before signing and ask questions about anything unclear. Deposits, cancellation and refunds are governed by the signed contract and applicable law.

Victorian cooling-off and statutory protections

Eligible purchases from a licensed motor car trader may carry cooling-off rights and a Victorian statutory warranty. Eligibility, exclusions, duration and consequences are determined by the Motor Car Traders Act 1986 (Vic), regulations and the circumstances of the transaction.

Australian Consumer Law rights

Goods and services supplied to consumers may come with guarantees that cannot be excluded under the Australian Consumer Law, including guarantees relating to acceptable quality, fitness for disclosed purpose and matching description.

Nothing in these terms excludes, restricts or modifies a consumer guarantee, statutory warranty, cooling-off right or other right or remedy that cannot lawfully be excluded, restricted or modified.

Any manufacturer, dealer or extended warranty operates in addition to, and does not replace, applicable consumer guarantees.

Selling or trading your vehicle

Information submitted through Sell My Car is used to assess whether we may be interested in the vehicle. An online estimate, initial indication or discussion is not a final purchase offer.

Any final offer may depend on physical inspection, identity and ownership verification, registration, VIN, kilometres, service history, condition, accident history, encumbrances and the accuracy of information supplied.

You must have authority to offer the vehicle and provide information that is complete and accurate. A purchase or trade-in proceeds only when the final terms and required documents are completed.

Intellectual property and user content

Website text, design, branding, graphics, code and original media are owned by or licensed to Roos and are protected by applicable law. Personal, non-commercial browsing is permitted.

When you upload vehicle photographs or other material, you confirm that you have authority to provide it and permit us to use it for assessing the vehicle, communicating with you and administering the relevant enquiry or transaction.

Website availability and limitation of liability

We take reasonable care in operating the website but do not promise uninterrupted, error-free or completely secure access. The website may be changed, suspended or unavailable for maintenance or circumstances outside our reasonable control.

To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising solely from use of, or inability to use, this website. This limitation does not apply where liability cannot lawfully be excluded or limited.

We may update these website terms when our services, website or legal obligations change. The current version is published on this page with its revision date.

These terms are governed by the laws of Victoria, Australia. The parties submit to the courts and tribunals having jurisdiction in Victoria, subject to any rights to bring a claim elsewhere under applicable law.

If part of these terms is invalid or unenforceable, it will be read down or severed to the extent necessary without affecting the remaining terms.
